Article 10 (Fair Use)

(3) When works are used in accordance with the preceding paragraphs of this Article, the source and the name of the author, if any, must be mentioned.

 

Article 10bis (News coverage)

((1) It shall be a matter for the legislation of the countries of the Union to authorise the reproduction by press, broadcast or communication to the public by wire of articles published in newspapers or periodicals on current economic, political or religious matters, as well as of broadcast works of the same nature, in cases where the reproduction, broadcast or such communication is not expressly reserved. However, the source must always be clearly indicated; the legal consequences of a breach of this obligation shall be determined by the legislation of the country in which protection is claimed.

(2) It shall also be for the legislation of the countries of the Union to determine the conditions under which, in reports of current events by photography, cinematography, broadcasting or communication by wire to the public, literary or artistic works seen or heard in the course of the event may, to the extent justified by the informational purpose, be reproduced and made available to the public.

 

2: United States Code of Law Title 17, Chapter 1, Sec. 106:

Limitations on exclusive rights: fair use

Notwithstanding the provisions of sections 106 and 106A, fair use of a copyrighted work, including such use by reproduction in copies or phonograms or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, shall not constitute an infringement of copyright. In determining whether a use of a work in a particular case is a fair use, the factors to be considered shall include:

(1) the purpose and nature of the use, including whether such use is commercial or for non-profit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use on the potential market for or value of the copyrighted work.

The fact that a work is not published does not of itself preclude a determination of whether it is a fair use if that determination is made in consideration of all of the above factors.

 

3) Canadian Copyright Act, Part III, Section 29.2

29.2 Fair use for the purposes of reporting does not infringe copyright if the following are cited: (a) the source; and (b) if indicated in the source, the name of (i) the author, in the case of a work, (ii) the performer, in the case of a performance by a performer, (iii) the producer, in the case of a sound recording, or (iv) the broadcaster, in the case of a communication signal. 1997, c. 24, s. 18.

(1) Quotation of a work already made public is permitted, provided that the quotation is in accordance with good conduct and does not exceed the scope justified by the purposes of news reporting, criticism or research.
(2) Reproduction by the press or other periodicals of information, investigation or statistical data, reports and other works of a similar nature, prepared by organs of the State or local public bodies, independent administrative bodies or autonomous local administrative bodies, for the purposes of information,

 

Article 39: Reproduction, etc. of articles on current affairs

(1) The reproduction by means of the press, broadcasting and wire transmission of articles published in newspapers or periodicals on current political, economic or social matters, not of a scientific nature, or the interactive transmission (including the ability to transmit by inputting information on an interactive transmission server already connected to telecommunications networks for public use) of such articles simultaneously with the reception of such transmissions, exclusively for the purpose of reception in the service areas intended for such transmission, is permitted; provided that such reproduction, broadcasting, wire transmission or interactive transmission thereof is not expressly prohibited.
(2) Communication to the public, by means of a receiving device, of articles thus transmitted, broadcast by wire or of which interactive transmission has been carried out is also permitted.

 

Article 41: Reporting Current Events

Article 41. For the purposes of reporting current events by photography, cinematography, broadcasting or otherwise, the reproduction and exploitation of a work involved in the event or a work seen or heard in the course of the event is permitted, to the extent justified by the informational purpose.
